SoSUE - Terms and Conditions
1. Scope of application
SoSUE GmbH, represented by the Managing directors Sue Giers and Vanessa Gieser, Goernestrasse 44, 20249 Hamburg, (hereinafter referred to as www.so-sue.com or “SoSUE GmbH”), runs an online shop at the Internet address www.so-sue.com by means of which especially fashion items, decorative items and accessories are offered for sale. These General Terms and Conditions (GTC) apply to all relevant legal relations between SoSUE GmbH and the customer (“customer” or “purchaser”), who can either be a consumer within the meaning of § 13 of the German Civil Code (“consumer”) or an entrepreneur within the meaning of § 14 of the German Civil Code (“entrepreneur”) and in any case must be of age.
The customer acknowledges the validity of these terms and conditions in the context of the order process by clicking on the “Buy now” field and submitting the completed order form. Any terms and conditions of the customer shall not apply, unless SoSUE GmbH has previously expressly agreed to their validity.
2. Important notes
The goods offered at www.so-sue.com are shown clearly on the website and are largely in accordance with reality. SoSUE GmbH, however, is not able to ensure a full match with reality in the images and colors that the customer sees on his or her screen, due to different screen types, graphics and/or printer settings.
2.2 Stock/prices of the goods
Please note that the products presented at www.so-sue.com may no longer be available or may be unavailable at the time the customer visits the site and the prices may have changed.
2.3 One-time seal
All goods ordered come with refund labels attached with a one-time seal and are delivered accordingly. When you try on the ordered goods, please be sure not to remove or damage the one-time seal. This makes it easier for us to process in the event of a return of the goods.
3. Contract conclusion
3.1 Purchase contract and order confirmation
The presentation of our goods does not constitute a binding offer on our part within the meaning of § 145 of the German Civil Code, only the order of goods by the customer represents a binding offer. The sale of goods is carried out via the order page on www.so-sue.com via our online shop. Here, the purchaser can insert the goods to be purchased in a shopping cart. By clicking on an “Order & Pay Now” button, the purchaser gives us a binding purchase offer. The proper receipt of the purchase order is confirmed by us at the end of the order process on the website. With the confirmation of receipt of the order, still no contract is concluded. A purchase contract comes about only with explicit order confirmation or the sending of the invoice or when the seller has shipped the ordered goods to the customer within 2-5 days, or has confirmed the shipment to the customer within 2-5 days with a second email.
3.2 Contract text
The contract text will not be stored by us and can not be retrieved after the completion of the order process. You can print the order data immediately after sending. You can either use the following page “Your order” or the email “Confirmation of receipt”. The customer can access and view these terms and conditions at any time via the subcategory “GTC” from the Homepage. The customer has the opportunity to print out these terms and conditions with the “print function” of the Internet browser or to store the corresponding website locally.
3.3 Contract with www.so-sue.com
Contracts are concluded exclusively with the company SoSUE UG “The contract language is German or English”
If the supplier does not supply us with the goods ordered by you, we are entitled to withdraw, unless we are at fault. In this case, we will inform you immediately that the ordered product is not available. If the purchase price has already been paid, it will be reimbursed immediately. The reservation of self-supply applies to consumers within the meaning of § 13 of the German Civil Code only in the case that a congruent covering transaction was concluded with the supplier, meaning that the supplier let us down and www.so-sue.com is not responsible for any incorrect or non-delivery.
4. Customer Service
4.1 Returns & exchanges
If you are not satisfied with a product or want to exchange for a different size, it is possible at any time within two weeks after receipt of the goods: All returns/exchanges must comply with our returns policy.
If you would like an exchange for an item, you can return it to us within the return period of two weeks. An exchange is only possible if the item is available. As soon as the item returned by you has arrived at our premises, the exchange will be made. To complete the exchange procedure, please follow these steps:
Contact SoSUE by email at email@example.com. Describe the item and use the order number and item number so that we can allocate the item.
You will receive a returns link via email from us.
For exchanges SoSUE GmbH assumes the shipping costs.
Please note that all ordered goods are in perfect condition. If the goods are used, worn, washed or damaged, www.so-sue.com is not obligated to take back or exchange the goods. If shoes show signs of wear or the shoes are not returned in the original box, acceptance of the item will not be accepted. We therefore advise you to try on shoes only on a carpet. We request the return of the shoes in their original packaging. Should you wish to offset an item with another item, unfortunately this is not possible due to administrative reasons. Please return the unwanted item and place a new order for the new item.

4.3 Refund periods
Please note that 10 to 14 days may elapse between the receipt of your return and the refund process. The time of payment refund depends on the credit card. It usually takes place within two bank statements. If the recipient of the products specified in the order is not the same as the purchaser of the goods, the deducted amount will always be refunded to the purchaser and the cardholder. 4.4 Damaged or incorrectly delivered items. If a damaged or incorrect item has been delivered to you, we kindly ask you to contact our service department immediately. Of course, we will take back this item, or will arrange an exchange or will credit you for the goods value immediately.
5. Delivery and shipping costs
Unless otherwise agreed, delivery is from the warehouse to the delivery address specified by the purchaser. After debiting your credit card account, we start the delivery process.
The prices indicated at the time of ordering on www.so-sue.com are decisive. These are gross prices, i.e. including the respective, legal value added tax and exclusive of any applicable shipping costs in accordance with Section 5.4.
5.3 National shipments
All shipments via DHL can generally not be delivered to any P.O. Box addresses or Packstations. The terms and conditions of DHL are additionally applicable and can be consulted at www.dhl.de
5.4 Shipping costs
Our goal is to process and ship the order within 48 hours. During the Sale Season, it can take up to three business days for the order to be processed. The estimated delivery times can only be given as a rough guideline and are valid from the date of shipment. SoSUE UG accepts no responsibility for any delays caused by extreme weather or other unforeseeable circumstances. The periods specified below are valid after the order has been shipped.

5.5 Special shipping method
If the customer desires a special way of shipping (e.g. express delivery), the customer shall bear the additional costs incurred according to the respective valid UPS price list. The transport risk passes to the customer when the goods are handed over to the carrier, unless the purchaser is a consumer and the order constitutes a consumer goods purchase for the consumer.
The purchaser can pay the purchase price and the shipping costs for the ordered items by credit card and bank transfer. With each order we reserve the right not to offer certain payment methods and to refer to another payment method. If the ordered goods are not available, the amount transferred in advance will be refunded immediately or credited back to the corresponding credit card.
6.1 Credit card
We offer payment by credit card in the following countries: Germany, Austria. The financial data for credit card transactions (card number, expiry date, etc.) are automatically forwarded with an encrypted protocol, without www.so-sue.com or any third parties being able to access them. These data will never be reused except for refunds for any returns. Please note that this is a direct debit.
We offer payment by Paypal in the following countries: Germany, Austria. You pay directly via your PayPal account. After submitting your order, you will be redirected to PayPal and release the order value there. As soon as our PayPal account has been informed about your authorization, the dispatch will take place, depending on the delivery time stated on the item. You can see the GTC of Paypal here.
6.3 Bank transfer
We offer payment by bank transfer with advance payment in all countries:

You will receive a confirmation email from us. As soon as we receive a payment receipt, we will send you the requested item.

6.4 Online security
www.so-sue.com uses the security software SSL (Secure Socket Layer). This is an asymmetric encryption method on the Internet that protects your credit card data from being intercepted and tampered with during transmission. When transmitting on the Internet, it is therefore not possible for unauthorized persons to read these data.
We currently only offer this payment method for orders in Euro.
7. Retention of title
The delivered goods remain the property of Jools GmbH until full payment is received.
8.1 Product descriptions
Information, drawings, illustrations, technical data, descriptions of weights, measurements and specifications contained in brochures, catalogs, circulars, advertisements or price lists are for informational purposes only. We assume no responsibility for the accuracy of this information.
Insofar as there is a defect subject to warranty, you are entitled within the scope of the statutory provisions to demand supplementary performance, to withdraw from the contract after failed supplementary performance, to reduce the purchase price or to claim damages in the event of a fault on the part of www.so-sue.com.
For damages other than injury to life, limb or health, we are only liable insofar as these are due to intentional or grossly negligent acts or culpable violation of a material contractual obligation (so-called “cardinal obligation”, i.e. an obligation, the fulfillment of which enables the proper execution of the contract in the first place and on the compliance of which the contractual partner regularly trusts and may trust) by us or our vicarious agents (e.g. the delivery service). Any further liability for damages is excluded. The provisions of the Product Liability Act remain unaffected; in addition, liability for the fraudulent concealment of a defect and for an expressly guaranteed quality remains unlimited.
The data communication via the Internet can not be guaranteed error-free and/or be available at all times according to the current state of the art. We are therefore neither responsible for the constant and uninterrupted availability of our online shop nor for technical and electronic errors during the processing of an order, over which we have no influence.
If links to other websites or sources are provided, we are not responsible or liable for the availability of such external sites or sources. We do not endorse any content that is accessible on such websites or sources and exclude any liability or warranty in relation to it, insofar as in individual cases there is no positive knowledge of the illegality of the content.
8.3 Limitation period
The limitation period for statutory warranty claims is 2 years and begins on the date of delivery, i.e. the receipt of the item by the purchaser. We ask you to complain immediately about a visible material, manufacturing or transport defect, this is not a condition for the effective assertion of warranty claims.

9. Right of withdrawal and return
9.1 Right of withdrawal
You have the right to withdraw from this contract within fourteen days without specifying any reasons.
The withdrawal period is fourteen days.
from when you or a third party named by you, who is not the carrier, has taken possession of the goods,
in the case of a contract for several goods which you have ordered as part of a single order and which are delivered separately, on the day on which you or a third party named by you, who is not the carrier, have taken possession of the last goods,
in the case of a contract for the delivery of goods in several installments or pieces, the day on which you or a third party named by you, who is not the carrier, has taken possession of the goods.
In order to exercise your right of withdrawal, you must inform us, SoSUE GmbH, Goernestrasse 44, 20249 Hamburg of your decision to withdraw from this contract by means of a clear statement (such as a letter sent by post or an email). You may submit an online downloaded sample withdrawal form or another clear statement to us. If you make use of this option, we will immediately send you an email confirming receipt of such withdrawal.
In order to comply with the withdrawal period, you simply need to send us notice that you are exercising your right of withdrawal before the withdrawal period has expired.
Consequences of the withdrawal:
If you choose to withdraw from this contract, we will refund all payments we have received from you without delay, including shipping costs (except for additional costs arising in the event of selecting a method of shipping different from the most cost-efficient standard delivery offered by us), no later than fourteen days from the date on which we have received the notice of withdrawal from this contract. The refund will be issued to the same payment method that you provided for the original transaction, unless otherwise explicitly agreed with you; under no circumstances will you be charged fees to process this refund.
We may withhold the money for refund until the items have been returned to us, or until you have provided evidence that you have sent the goods back, whichever is earlier.
You must send back or hand over the goods to us without delay, no later than fourteen days from the day on which you notified us about withdrawing from this contract, to

The deadline is met if you send the items back before the period of fourteen days has expired. We will bear the cost of returning the goods if you send them in accordance with our instructions by means of our designated logistics partner. Otherwise you bear the direct costs of the return.
You must only compensate any loss to the value of the goods if this loss of value is due to handling which is unnecessary for the examination of the nature, characteristics and functioning of the goods.

9.2 Refusal of acceptance
Please note: If you refuse to accept the package, www.so-sue.com reserves the right to charge you for any additional costs incurred.
These costs include, but are not limited to, the following: the initial shipping charges, any applicable import sales tax and any custom duties, the cost of return shipment to www.so-sue.com and other costs incurred.
10. Final provisions
10.1 Applicable law
The law of the Federal Republic of Germany applies, excluding the UN Sales Convention (CISG).
If the customer is a merchant, a legal entity under public law or a special fund under public law, Hamburg is the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship.
10.3 Ineffective business terms, “business conditions” or as is usual “severability clause”
If any provision of these terms and conditions is or becomes invalid, the validity of all other provisions or agreements shall not be affected. In place of the invalid provisions, the relevant statutory provisions apply.
